1. Use of the platform
Kiwi Classes connects K‑12 learners and parents with screened tutors, supported by a learning consultant who helps with matching, scheduling, and payments. You agree to use the platform only for its intended purpose and in compliance with applicable laws.
2. Accounts and eligibility
Parents or legal guardians must create and maintain accounts on behalf of minors. You are responsible for keeping your credentials secure and for all activity that occurs under your account.
3. Sessions, payments, and refunds
All tutoring sessions arranged through Kiwi Classes must be booked, delivered, and paid for through the platform or via payment instructions issued by Kiwi Classes or your learning consultant. Pricing, currency, and refund eligibility are confirmed in writing before a package begins. Cancellations made within the published window receive a credit; outside that window, fees apply per the package terms.
Off‑platform payment is prohibited. See Section 4 for the full policy on communications and payments outside Kiwi Classes.
4. Off‑platform communication and payments (parents and tutors)
Kiwi Classes is designed to keep families, learners, and tutors safe, accountable, and fairly supported. To protect everyone on the platform, the following rules apply equally to parents and legal guardians and to tutors (teachers) from the moment you create an account or are matched through Kiwi Classes, and for so long as a tutoring relationship exists or could reasonably be connected to the platform.
4.1 What is not allowed
You must not, directly or indirectly:
- Share or request personal contact details intended to communicate outside Kiwi Classes — including personal email addresses, phone numbers, messaging app handles (e.g. WhatsApp, Telegram, Signal), social media profiles, or other off‑platform contact methods — except where Kiwi Classes expressly provides or authorizes such contact for a specific purpose.
- Solicit, offer, accept, or arrange payment for tutoring services (including demos, trial lessons, packages, make‑up sessions, or referrals) outside the Kiwi Classes platform or outside payment flows authorized by Kiwi Classes.
- Encourage, assist, or facilitate another user to bypass Kiwi Classes for communication, booking, scheduling, or payment.
- Use information obtained through Kiwi Classes to contact, recruit, or transact with a user outside the platform in connection with tutoring or related educational services.
4.2 Why this matters
Platform‑only communication and payment helps us verify tutor credentials, enforce safeguarding standards, maintain session records, process refunds and disputes fairly, meet tax and regulatory obligations, and provide support when something goes wrong. Circumventing these controls removes protections for learners and exposes all parties to increased risk of fraud, harassment, data misuse, and unqualified instruction.
4.3 Enforcement and account action
We monitor for policy violations and investigate reports from users, learning consultants, and automated safeguards. If we determine, in our reasonable discretion, that you have shared personal contact details or engaged in off‑platform payment or solicitation — whether or not money changed hands — we may, without prior notice where appropriate:
- Issue a formal warning and require corrective action;
- Suspend your account temporarily or permanently;
- Cancel pending or future bookings and decline new matches;
- Withhold or adjust tutor payouts related to affected sessions, subject to applicable law;
- Permanently ban you from Kiwi Classes and refuse re‑registration under the same or a related identity.
A ban may apply to the parent or guardian account, linked student profiles, and/or the tutor account involved, as determined by the circumstances of the violation.
4.4 Legal consequences
Off‑platform solicitation and payment may constitute a material breach of these Terms and of any separate agreement you have with Kiwi Classes (including tutor onboarding or independent contractor terms). In addition to account termination, Kiwi Classes reserves all rights and remedies available at law or in equity, which may include:
- Seeking recovery of fees, commissions, or damages arising from the breach, including lost platform revenue and reasonable enforcement costs;
- Pursuing injunctive or other equitable relief to prevent further circumvention of the platform;
- Referring suspected fraud, tax evasion, harassment, or child‑safety concerns to relevant authorities or payment partners where required or appropriate.
Nothing in this section limits any rights you may have under mandatory consumer protection or employment laws in your jurisdiction. If you believe a user is pressuring you to communicate or pay off‑platform, decline the request and report it to Kiwi Classes immediately.
4.5 Reporting violations
If another user asks you to share contact details or pay outside Kiwi Classes, do not comply. Notify your learning consultant or email info@kiwiClasses.com promptly with any relevant details. Good‑faith reports are taken seriously and handled confidentially where possible.
5. Conduct
We expect respectful, harassment‑free interactions between learners, parents, tutors, and staff. Circumventing platform communication or payment rules (Section 4) is a serious conduct violation. We may suspend or terminate access for behavior that violates this policy or harms the safety of the community.
6. Intellectual property
Lesson materials, recordings, and platform content remain the property of their respective owners. You are granted a limited, non‑transferable license to use them for personal learning only.
7. Limitation of liability
Kiwi Classes provides matching, scheduling, and coordination services. We do not guarantee specific academic outcomes. Liability is limited to the fees paid for the affected session(s) to the maximum extent permitted by law.
8. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via email or in‑app notice. Continued use after the effective date constitutes acceptance.
